Dear Sirs,
Thank you for this clarification, even though the result is
disappointing.
So please let me at least maintain my – hopefully –good reputation in
the Paracycling scene by explaining the ‘reasons’ for the below mentioned ban
pronounced by the Austrian handicapped sports association (ÖBSV).
As some of you might remember, I was nominated last year for the
Paralympic Games by a majority decision of the experts from the Austrian
Paracycling department. When I got this message, I set up a fantastic race
package, consisting of a new time trial machine specifically designed for the
corner-rich, demanding race course in Brands Hatch, 3 weeks altitude training
in Switzerland and I even gave up my job as an IT professional to make my
Paralympic dream of a medal, probably the last and only one of my life, come
true. Just 6 weeks before the games I proved my excellent shape by a superior
victory in the P1 time trial at Holzkirchen with more than 1k avg speed
advantage over the later Paralympic TT bronce medalist in my division, Jeffre.
However, three weeks after this decision I was surprisingly replaced by another
athlete who not only delivered poor results in the relevant qualification
competitions, but also has not won any medals in the big UCI events for the
last five years. The federated sports commission (BSA) of the ÖBSV, led by the
so-called sports director, the majority of which has poor understanding of
Paracycling, overruled the decision of the Paracycling experts for the first
time in Austrian handicapped sports history. To understand this odd decision,
you have to know that my substitute himself owns several functionary tasks in
the ÖBSV and is very well connected to most of the BSA members. I also got some
wind that monetary aspects might have played a role as the ÖBSV continuously
suffers from financial problems after a close colleague of the sports director
recently misappropriated more than 1 million (!!) Euro. In any case it
was not a big surprise that my substitute ended up on one of the last positions
in all three competitions he took part of. The Austrian relay team was made ridiculous
being equipped with two tetraplegics.
I hope you understand now why I was not willing to accept the way how
the ÖBSV treated one of their most passioned athletes and publicly complained
about their scandalous procedure.
Last not least I would like to point out that in case that under these
special circumstances there are any smart ideas from UCI side to make my start
in Merano happen, it still would be a great honour for me to contribute an
excellent performance to this amazing event. What about a start as a
forerunner, like we know it from alpine skiing?After my excellent result
today in the P1 time trial in Switzerland where I was even able to beat
the Paralympic champion in my category, Wilk, I would already be happy to
see where my current performance level is compared to the complete set of elite
riders even if my name does not appear in any result list.

Dear Christophe,
sorry for answering after the deadline, your emails to Elmar Sternath
and the last two from Elmar Sternath were lost in my spam folder.
I am not sure if you are informed Elmar Sternath is banned by the
Austrian Disabeld Federation for one year because of disiplinary matters.
Therefore I told him about two weeks ago, he should try to get a
registration from the German Cycling Federation or from the UCI itself as an
independent competitor.
The Austrian Disabled Federation doesn't want us to register him for
Austria. As the rules state the following, we couldn't find a way to register
Elmar Sternath as an Independent, not counting him or his ranking points for
Austria :
1.2.052
National, regional and club teams and their respective
riders may not start in competitions abroad
unless they hold authorisation in writing issued by their federation
(except teams and riders from the
same federation as the event organiser). This authorisation must carry
the dates of validity and the
name(s) of the rider(s) concerned.

country, the applicant has his main residence at the time of application. He
shall remain affiliated to that federation until the expiry of the licence,
even if he changes country of residence.
For this season
2013, it’s a licence from German with an Austrian number (for you AUT19670612)
For the
registration in world cup you pass by your Austrian federation.

My name is Elmar Sternath, my home residence is
located in Germany, this is why I hold a German license from BDR. My license
number is AUT19670612 because I only have Austrian, no German citizenship.
Sorry, my license for 2013 is not yet available and the one for 2012 not any
more. In the past I always started for the Austrian national team but now I am
no team member any more. However I still perform at World class level and
therefore it would be a great pleasure for me to be part of this great event in
a wonderful environment!

Participation
16.20.004 The competitions shall be for national selections or teams or individuals under recommendation of
the affiliated National Cycling Federation.
16.20.005 The nation’s maximum number of participants in each event will be three per sport class.
In all Para-cycling World Cup events, the nation of the winner of the previous year’s World Cup shall
have the right to an additional place to be taken up by that winner of the previous year’s World
Cup. If the winner of the previous year’s World Cup cannot take part, this place is not added to that
nation’s quota.

16.20.006 National Federations shall confirm their participation by means of an enrolment form no
later than three weeks before the first race of the World Cup. At the time of registration,
up to four substitutes can be added on the team for all classes combined. This
confirmation shall mention the number of persons making up each delegation, registration
of riders in each race as well as their sport class, accommodation used during the event,
full coordinates of the team responsible and each athlete’s time of arrival.
After the registration deadline (3 weeks before the world cup), late registrations
may be accepted no later than 10 days prior to the start of the competition, and in
exceptional circumstances only. In the event of late registration, a payment of CHF
100.- per rider per day late is due. After this deadline, no late registration will be
accepted any more.
Starters must be confirmed in each sport class during the official confirmation time
as announced in the technical programme of the event.
A single representative for each National Federation shall proceed to confirm the starters
for all the athletes of that nation, whether they are participating through the national team,
as individuals or for any other team under the recommendation of the National
Federation.
Last minute changes can only be done under medical certificate up to 24 hours before
the start of the its race.
